Commercial high court grants interim injunction to protect “Garsy” trademark

The Commercial High Court of the Western Province (Exercising Civil Jurisdiction) Holden in Colombo has granted an enjoining order and interim Interim Injunction Notice in Case No. CHC 08/2026/IP, concerning a trademark infringement dispute relating to the brand name “Garsy.” The Plaintiff is the registered owner of the trademark “Garsy” and has been using the brand name in relation to its products since 2024. The Plaintiff informed Court that the Defendant had begun marketing similar products under the brand name “Garcy,” which is phonetically similar to the Plaintiff’s registered trademark.

Submissions made before Court further stated on behalf of the Plaintiff, that the Plaintiff had obtained the necessary approvals from relevant authorities, including the Ayurvedic Department, whereas the Defendant had allegedly failed to secure such approvals for their products. It was also submitted that the Defendant had used advertisements similar to those of the Plaintiff, potentially affecting the goodwill and reputation of the Plaintiff’s brand. The Defendant is further alleged not to have registered the disputed trademark.Upon considering the submissions, pleadings, and documents tendered, the Court granted an enjoining order restraining the Defendant for a period of 14 days, as prayed for in the Plaint.
